These terms govern your use of legacycheck.co.za and all services provided by LegacyCheck (Pty) Ltd. By using our website, you agree to these terms.

By accessing or using LegacyCheck, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement. If you are using LegacyCheck on behalf of an organisation, you confirm you have the authority to bind that organisation to these terms.

about legacycheck

LegacyCheck is an estate administration transparency platform that provides:

  • Free public access to deceased estate status information, sourced from the Master of the High Court
  • A fee estimation calculator based on published tariff schedules
  • Plain-language guides, a glossary of estate terms, and educational resources
  • Subscription-based portfolio monitoring tools for estate practitioners (when available)

LegacyCheck is an information platform, not a law firm. Nothing on this website constitutes legal, financial, or professional advice. Estate administration is a complex legal process — we strongly encourage you to consult a qualified attorney or estate practitioner for advice specific to your situation.

accuracy of estate information

The estate status data we display is sourced from the Master of the High Court's publicly accessible records. We make no representations about the accuracy, completeness, or timeliness of this data. Government records may be delayed, incomplete, or contain errors.

Fee estimates provided by our calculator are approximations based on published tariff schedules and exclude VAT where indicated. They do not constitute a quote from any executor, attorney, or the Master's Office.

acceptable use

You may use LegacyCheck only for lawful purposes. You may not:

  • Use automated tools to scrape or bulk-query estate data without our prior written consent
  • Attempt to circumvent bot-protection, rate-limiting, or security measures
  • Use our services in a way that infringes another person's rights or South African law
  • Transmit harmful, fraudulent, or misleading content
  • Attempt to gain unauthorised access to our systems, databases, or infrastructure

We reserve the right to suspend or terminate access for any user who violates these terms.

free tools

Our free estate lookup, fee calculator, guides, glossary, and checklist are provided without charge and without any guarantee of continuous availability. We may modify, limit, or discontinue free tools at any time, though we will try to provide reasonable notice.

When our subscription plans become available, separate subscription terms and pricing will apply. Fees are denominated in South African Rand (ZAR) and exclude VAT unless stated otherwise. Refund and cancellation policies will be set out in the applicable subscription agreement.

intellectual property

All content on LegacyCheck — including text, design, graphics, and software — is owned by or licensed to LegacyCheck (Pty) Ltd and is protected by South African copyright law. You may not reproduce, distribute, or create derivative works from our content without prior written consent, except where permitted by law.

Estate data sourced from government records is in the public domain; our presentation, curation, and plain-language interpretation of that data remains our intellectual property.

third-party services

LegacyCheck integrates with third-party services, including Cloudflare for bot protection and the Master of the High Court's data systems. We are not responsible for the availability, accuracy, or conduct of any third-party service, and links to external websites do not imply our endorsement.

limitation of liability

To the maximum extent permitted by South African law, LegacyCheck (Pty) Ltd shall not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of our services
  • Decisions made in reliance on estate status information or fee estimates displayed on our platform
  • Loss or damage resulting from inaccurate or unavailable government data

Our total liability for any claim arising from these terms shall not exceed ZAR 1,000 or the total amount you paid us in the preceding 12 months, whichever is greater.

Nothing in these terms limits liability for fraud, gross negligence, or conduct that cannot be excluded by applicable South African law.

governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute arising under these terms shall be subject to the non-exclusive jurisdiction of the courts of South Africa, with Cape Town as the chosen venue.

changes to these terms

We may update these terms at any time. Changes take effect when we post the updated terms on this page with a revised "last updated" date. Continued use of our services after any changes constitutes your acceptance of the updated terms.
